If you have received a Notice of Default or a Notice of Breach since July 1, 2009, you may have noticed the inclusion of a form where you can elect mediation. This form is now required by state law, and if you respond within 30 days you can elect to take advantage of an opportunity virtually unique in the nation that forces lenders to come to the negotiating table.

It's important to act quickly to protect your rights and your options. If that 30 days goes by without action on your part, you can lose your bargaining power.

As an alternative to bankruptcy options for clients who still have the opportunity to pay their mortgage and simply need a more realistic payment plan, foreclosure mediation doesn't force lenders to renegotiate, but it does give the homeowner certain advantages.
